If this is a contemporary picture (it doesn't say when it was created), then the picture is PD because of age since the subject died in 1816. If it isn't a contemporary picture, then it doesn't satisfy WP:NFCC (violating either WP:NFCC#1 if it's based on a contemporary picture, or WP:NFCC#1+WP:NFCC#8 if the artist only guessed what the person looks like).
