Neither a toupha nor Justinian, apparently

For the misidentification of the statue as that of Justinian, see the entire detailed article ["Theodosius or Justinian? A Renaissance Drawing of a Byzantine Rider" (The Art Bulletin, 41:39-57 (1959)] in which [Phyllis Williams Lehmann] unravels the long-standing misidentification; for the mistaken identification of the headdress as a toupha, see [note 12 in that article], agreeing with [André Grabar] and J. Kollwitz.
