See e.g. which states the code is in the public domain. I'm not sure this is actually possible though (it definitely was, in the US, until 1989). Rp (talk)

Up to version 1.4 it was in public domain (copyright notice, ).

According to https://news.netcraft.com/archives/category/web-server-survey/ Apache is no longer the #1 webserver on the net, that seems to be Microsoft for the past few years now.
