Practitioner-application content for Section 3 fair presentation (COI disclosed)

COI disclosure: I am Matt Bartlett, director of Apex Insurance Brokers Limited (FCA FRN 724952), a UK commercial insurance broker. Per WP:COI I am proposing a source here rather than editing the article directly.

The article is well-cited on the legislative provisions themselves but contains no "Implementation in practice" or "Post-2016 case law" section. The duty of fair presentation under Section 3 has been litigated repeatedly since 2016 (Young v Royal and Sun Alliance Insurance Plc [2019] CSOH 32; Berkshire Assets (West London) Ltd v AXA Insurance UK Plc [2021] EWHC 2689 (Comm); Jones v Zurich Insurance Plc [2021] EWHC 1320 (Comm), among others). A practitioner-oriented summary aimed at brokers and risk managers may be a useful navigation source, particularly for the relationship between Sections 3–5 (what counts as "known or ought to be known" within an insured organisation).
