The text says that the FWA test was dead at the time of the CAFC Bilski decision (October 2008). Afaik the FWA test became less and less influential from the very moment it was established, in the early 1980s. In 1990 the influence was still only minimal, and the moment of abolishment is IMHO definitly not later than the 1998 State Street Bank decision, that adopted the "useful, concrete & tangible" test.
