Dwayne J. Bensing (born February 25, 1984) is an American civil rights attorney, educator, and political candidate who serves as the legal director of the ACLU of Delaware and is running in the 2026 Delaware Attorney General election [1].

Education University of Arkansas (cum laude) and Truman Scholar University of Pennsylvania Law School - J.D. [2]

Early Life Dwayne Bensing grew up in Springdale, Arkansas. After graduating from Springdale High School, Bensing attended the University of Arkansas in Fayetteville, graduating with a major in Political Science and Communications. He was selected as a Truman Scholar in 2006.

Career Bensing joined Teach for America after graduation and taught middle-school Science and Social Studies in Philadelphia Public Schools.

Bensing's professional background is in civil-rights law. Before moving to Delaware, he worked in the U.S. Department of Justice’s Civil Rights Division on litigation involving civil liberties, student rights and school desegregation. He later became a whistleblower, claiming that the U.S. Department of Education had improperly launched an investigation into transgender student athletes in Connecticut during the first Trump administration. [3] [4]

As legal director of the ACLU of Delaware, a position from which he is currently on leave during his campaign for Attorney General of Delaware, Bensing has pursued a slew of civil-rights litigation. That litigation includes large scale prisoner-rights lawsuits, individual cases like one involving a person with serious mental illness locked in solitary confinement, challenges to Delaware’s loitering laws, religious-accommodation disputes and representation of protesters facing prosecution related to demonstrations over police violence.[5]

Other Awards: Bensing was named to the 2014 LGBT Bar 40 Under 40 by the National LGBT Bar Association. [6]
