Dmytro Ihorovych Lyushenko (Ukrainian: Дмитро Ігорович Люшенко; born 9 July 1991) is a Ukrainian lawyer and legal researcher based in Sacramento, California. He is a licensed advokat in Ukraine, a Registered Foreign Legal Consultant with the State Bar of California, a commissioned notary public in California, and a representative of the Ukrainian National Bar Association in the United States.[1][2][3] His research concerns the legal status of digital assets after the death or incapacity of their owner, including conflict-of-laws, technical and regulatory aspects of digital inheritance, and in 2025 he submitted proposals on the subject to the U.S. Securities and Exchange Commission.[4]

Early life and education

Dmytro was born on 9 July 1991 in Mykolaiv, Ukraine. From the age of 9 to 16 he competed in cycling.[1] He received a Bachelor of Laws from Kyiv International University in 2012 and, from 2014 to 2016, studied for a master's degree in international and business law at the Interregional Academy of Personnel Management in Kyiv.[1]

Lyushenko's early legal work included serving as an assistant to a judge in Zhytomyr Oblast.[3] After completing his undergraduate studies, he worked at a corporate law firm, and in 2015 he founded the law firm Dmytro Lyushenko and Partners, where he practiced business and corporate law.[1] In December 2016, as the owner of the firm, he was among the scheduled speakers at the regional business forum "Ukraine – a Country of Entrepreneurs" in Zhytomyr, organized by the Ukrainian Union of Industrialists and Entrepreneurs with PrivatBank.[5] He also served as president of a charitable organization.[3] In 2019 he obtained the status of advokat and is registered in the Unified Register of Advocates of Ukraine maintained by the Ukrainian National Bar Association.[3][6]

United States

Following the Russian invasion of Ukraine, Lyushenko moved to the United States.[1] In California he became a commissioned notary public and a registered legal document assistant, and he was registered by the State Bar of California as a Foreign Legal Consultant in Ukrainian law.[1][2] In March 2025 the Ukrainian National Bar Association appointed him as one of its representatives in the United States, based in Sacramento, by an order signed by the association's head, Lidiya Izovitova.[3][7] On his appointment he said he intended to help Ukrainian lawyers who had relocated to the United States after the start of the war to adapt professionally and have their qualifications recognized.[3]

He founded Golden Gate Visa LLC, which provides immigration and legal document services; NOTA LLC, a legal technology and digital asset company; the nonprofit NOTA Digital Currencies Research Center Inc., which conducts research on Web3 and digital assets; and GRACE Inc., a nonprofit providing humanitarian and educational services to low-income immigrants and refugees.[1]

Research

Lyushenko's research addresses what happens to digital assets, such as crypto-assets, digital wallets and online accounts, when their owner dies or loses legal capacity. He approaches the question from three directions: which national law governs the succession of assets that have no physical location, how inheritance can be built into the technical design of systems that hold digital assets, and how financial regulators should treat inheritance within the rules on digital asset custody.[8][9][4] Most of this work is carried out through the NOTA Digital Currencies Research Center in collaboration with Oleksandr Tuholukov and Rodion Sharafan.[1][4] Between 2023 and 2025 he authored or co-authored studies published in Ukrainian and international journals and conference proceedings.

Private international law and cross-border succession

In a 2023 conference paper, Lyushenko and Tuholukov compared how the United States and Ukraine determine the law applicable to the inheritance of digital assets. The paper examined whether traditional connecting factors of private international law, such as lex rei sitae (the law of the place where property is located) and lex domicilii (the law of the deceased's domicile), can be applied to intangible assets that have no physical location. It discussed the UNIDROIT Principles on Digital Assets and Private Law and proposed changes to national legislation to support the cross-border inheritance of crypto-assets.[8] In a 2025 article, Tuholukov and Lyushenko argued that the international unification of standards governing digital heritage is a prerequisite for compatibility between national legal systems in cross-border cases.[10]

With Sharafan and Tuholukov, Lyushenko proposed models of the inheritance process for digital assets based on blockchain technology[9] and described information systems for managing a person's digital heritage and integrating it into legal procedures such as probate.[11] A related article examined the design of encrypted "digital safes" in which assets intended for heirs can be stored and transferred.[12] In another 2025 article, Tuholukov and Lyushenko argued that self-sovereign identity, in which individuals control their own digital credentials without intermediaries, can serve as the basis for trust and digital asset management in Web3 environments.[13]

Digital inheritance as a regulatory issue

In November 2025, Lyushenko and Tuholukov submitted written input to the Crypto Task Force of the U.S. Securities and Exchange Commission, which the Commission published on its website. The submission argued that discussions of digital asset custody have focused on the segregation of client assets, cybersecurity and operational resilience, but have generally not addressed what happens to custodied assets when their owner dies. It treated inheritance as a regulatory rather than purely private-law question and recommended that custody rules explicitly address inheritance and succession, and that the Commission set baseline expectations for "digital vault" architectures. The authors described the issue as one of national importance because of its effect on retirement security and intergenerational wealth transfer.[4]

Lyushenko has also co-authored studies on the tokenization of real-sector assets, which analyzed the market for tokenized assets and its potential effect on global capital markets,[14] and on econometric forecasting of the cryptoasset market using high-frequency and behavioural data.[15]
