Proposed "Trademark" section
[edit]COI disclosure: I have a conflict of interest — I co-founded One Mighty Roar, which operated the would-you-rather app named below — so per WP:COI I'm proposing this here rather than editing the article, and leaving inclusion and wording (especially any mention of the app) to independent editors.
The phrase "Would You Rather" has a documented U.S. trademark history that may merit a short section:
- Spin Master Ltd. has held U.S. registrations for WOULD YOU RATHER...? (Justia).
- Its enforceability was litigated between Falls Media and Zobmondo Entertainment — a district court found the mark generic, reversed on appeal — and after acquiring the mark Spin Master won a judgment reported at $8.6M (Law360). (I have not verified the exact Falls Media v. Zobmondo citation — an editor should confirm it.)
- In December 2013, One Mighty Roar filed a declaratory-judgment action against Spin Master (D. Mass., No. 1:13-cv-13241) seeking non-infringement and cancellation of Spin Master's registrations as descriptive/generic, after Spin Master sent takedown notices to Apple and Google (Boston.com; Techdirt).
