It is amazing how this fellow has gained immortality by accident as a carpet pitchman. Copyright status of classic commercials

It turns out that none of Empire Today's commercials before 1988 were published with a copyright notice. Starting at some point in 1988 (between Feb and April), they added in the copyright notice "(C) 1988 Empire Home Services, Inc." Starting after March 1989, copyright notices were longer required, and everything is protected under copyright.

Since a copyright notice can also be present in the unaired "leader" (initial 5 seconds where advertiser information is displayed), I checked some of the Youtube uploads from Empire Today that have the leaders intact, and none of the leaders seen there have any copyright notices.

As for whether the ads were were registered with the copyright office within 5 years, that would need to be checked on a case-by-case basis. Dwedit (talk) 18:21, 24 April 2026 (UTC)
