Rachel Ann Pepper is a Judge at the Land and Environment Court of New South Wales, Australia. She was appointed to the Court in 2009.[1]

Early life and education

Rachel Pepper was born in Canada and immigrated to Australia in the early 1980s. She completed her secondary education at Swanbourne Senior High School in Perth, Western Australia, graduating in 1984.[2]

She graduated from the Australian National University with a Bachelor of Arts, majoring in French, in 1992 and a Bachelor of Laws with First Class Honours in 1994.[3]

Pepper practised as a solicitor with Allen Allen & Hemsley in 1995. In 1996, she served as associate to Justice Michael McHugh in the High Court of Australia.[4]

She was called to the New South Wales Bar in 1997, reading with John Marshall and Justin Gleeson. She practised as a barrister at 7 Wentworth Chambers and 12 Wentworth Selborne Chambers until her appointment to the Court in 2009.[5]

Between January 2017 and April 2018, Pepper served as Chair of the Scientific Inquiry into Hydraulic Fracturing of Onshore Unconventional Gas Reservoirs and Associated Activities in the Northern Territory.[6]

In 2021, she was made a fellow of the Australian Academy of Law.[7]

Professional activities

Pepper serves on the editorial board of the Australian Journal of Administrative Law and is the Environment Section Editor of the Australian Law Journal.[8]

From 2009 to 2018, she was a Co-Consulting Editor of the Australian Environment Review published by LexisNexis.[9]

She has served on the committee of the Australian Institute of Administrative Law and was its President.[10] She is also a member of the Ngara Yura Committee of the Judicial Commission of NSW[11] and a judicial member of Football Australia.[12]

Pepper served as Secretary of the Australian Association of Constitutional Law from 2013 to 2017 and as Vice President from 2017 to 2018.[13]

She was elected to the NSW Bar Council in 2000 and served until her appointment to the bench in 2009, including as Secretary from 2005 to 2009.[14]

From 2019 to 2023, Pepper was a board member of Twenty10. She also served as Vice President of ACON from 2001 to 2003.[15]

Pepper has authored and edited books, journal articles, book chapters and other publications in the fields of environment, administrative, constitutional, criminal and discrimination law[16]. She has also participated in the teaching and training of judges from overseas in environmental law and environmental dispute resolution through programs supported by the International Union for Conservation of Nature (IUCN), the United Nations Environment Programme (UNEP) and the Asian Development Bank.[17]

Academic appointments

Pepper is an Adjunct Professor at the University of Sydney Law School[18].

She has been a judicial fellow and visiting scholar at the Australian National University College of Law[19] and Melbourne University Law School[20]. She has also taught law courses at the University of New South Wales, the University of Technology Sydney and the University of Sydney.[21]
