Hi User:Fred Bauder. I know what you mean. However, in this case I checked the High Court opinion and it does appear that the Guardian is more or less correct this time. A number of other press sources also say the same thing. I've added links to a BBC.com article, the High Court opinion itself, and a case comment analyzing the opinion in plain(er) language so it will be more clear.
