How can I evict someone from my house that is not on my rental lease? The landlord wants for them to go, but says I need to get them out.

If the resident the landlord wishes to be be removed from the property is not under the leasing agreement, the person must leave when requested by either you or your landlord, or they are considered to be trespassing. It depends on what your lease says regarding occupants and what the limitations are, etc.

Uninhabitable or interfering with right of possession/use?

  • I'm pretty sure constructive eviction does not have to do with whether the premises is uninhabitable, since it may be claimed by a commercial tenant leasing commercial property. Does anyone more knowledgeable want to fix that? Yoink23 (talk) 23:43, 15 December 2008 (UTC)Reply
    • Even a commercial tenant may be constructively evicted if, for example, the premises become infested with vermin, and the landlord refuses to do anything about it. bd2412 T 00:22, 16 December 2008 (UTC)Reply

Someone claiming wrongful Constructive Eviction

[edit]

I have a lease agreement that this person signed that she must put into writing that she intends to terminate the lease. She verbally stated she would be out on the 15th. She now is claiming this Constructive eviction. —Preceding unsigned comment added by 99.180.29.145 (talk) 17:13, 11 May 2010 (UTC)Reply
