General description
[edit]Natural Resource Damage Assessment and Restoration (NRDAR), or just Natural Resource Damage Assessment (NRDA), is a process of calculating monetary damages after natural resources have been injured by a release of hazardous substances[1]. The process includes injury assessment and valuation[2]. In the United States methods are discussed in federal and state regulations, although comparable methods are performed internationally[2][3][4]. It is a structured process that is often collaborative and results in restoration to reverse harm caused by releases of hazardous substances[1][2].
NRDAR in United States federal regulations
[edit]United States federal regulations (such as the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Oil Pollution Act (OPA), and others) require polluters to cleanup unauthorized releases of hazardous substances and oil. Additionally, these laws allow natural resource trustees to perform NRDAR.[5][6] While methods for performing NRDAR can vary,[7][8][9][10][5][11][12][13] CERCLA and OPA provide steps. Following procedures laid out in these regulations is not mandatory, although their use triggers a rebuttable presumption[6][2].
In the United States, natural resource trustees are designated by federal, state, and tribal governments.[14][15][5][16] Federal trustees are designated by the President of the United States, and often include NOAA (through the Office of Response and Restoration) or USFWS. State trustees are appointed by their state's governors[15] and tribal trustees are appointed by their governing bodies.[14] Every state designated one or more trustee organizations,[17] however not all states have active NRDAR programs that are prepared to respond after an accident.[18][19]
Individual states may either use the process defined in CERCLA and OPA or use their own state regulations,[19][20][15] although not every state has adopted their own NRDAR regulations.[15] Many states allow federal trustees to take the lead. CERCLA requires the U.S. Environmental Protection Agency to notify trustees when injury to natural resources may have occurred, and to invite trustees to participate in the NRDAR[21].
Responsible parties must reimburse trustees (the trustee organizations performing the NRDAR) for restoration and for the cost of assessing the injury.[6] In the United States, reimbursement covers: 1) the reasonable cost of assessing damages, 2) the cost of restoring/rehabilitating until full recovery of the resources (or acquiring the equivalent of the injured natural resources), and 3) lost past-use of ecosystem services for legacy releases.[16][8][6]
In the United States, injury to natural resources can be the result of exposure to hazardous substance, the cleanup itself (driving machinery through habitat) or even actions in response to a threat of a discharge.[16][22][23] Natural resource valuation is performed during natural resource damage assessments. Trustees must quantify the severity of injuries, determine how much the responsible party owes the public (often defined in monetary damages),[24] and then develop restoration plans to restore ecosystem services.[16][8][10] The US Department of the Interior maintains a library of NRDAR cases for public access, for NRDAR cases in which the US DOI is involved.[25] The US National Oceanic and Atmospheric Administration maintains a library of NRDAR cases for public access for NRDAR cases in which US NOAA is involved.[26]
NRDAR regulations elsewhere
[edit]Other countries have similar procedures to determine injuries due to releases of hazardous substances and to determine the level of restoration that would offset those injuries.[2][3] Additionally, NRDA regulations from the United States have been used for assessment of natural resource injury abroad.[4] The European Union uses authorities in the Environmental Liability Directive 2004 to define damages liability and allows trustees of natural resources to act on behalf of the public to perform injury assessments[27]. The preferred form of compensation is full restoration.[27][28] Processes similar to NRDA are also used in Canada through the authorities provided in the Federal Environmental Enforcement Act [2].
