Mohit Dhawan is an Indian prosthodontist who practises in Chandigarh.[1] He has been involved in a series of legal disputes that began with a 2018 cheating case registered against him on the complaint of a US-based patient. He alleged that the case had been brought at the behest of Rakesh Asthana, then special director of the Central Bureau of Investigation (CBI), a claim the Delhi High Court rejected in 2021.[2] In January 2022 he alleged that he had been abducted by Chandigarh Police personnel outside the district court complex in Chandigarh. On the direction of the Supreme Court of India, the CBI investigated the allegation and in 2026 filed a charge sheet naming nine police personnel as accused.[3][4]
Early life and education
[edit]According to his clinic's website, Dhawan received a postgraduate degree in prosthodontics from Pandit Bhagwat Dayal Sharma University of Health Sciences in Rohtak. The same profile states that he completed an advanced implantology clinical programme in Zeist, Netherlands, and further training at the Latin American Institute of Dental Research and Education (ILAPEO).[5]
Career
[edit]Dhawan runs a dental practice in Sector 21, Chandigarh, known as Avance Dental Care and later as ADC Centre for Restorative and Implant Dentistry, together with his wife, who is also a dentist.[6][1][5] The practice offered overseas patients dental tourism packages that combined implant treatment with hotel accommodation and sightseeing.[6][7]
In May 2026, local media reported that he had been awarded a fellowship of the International Team for Implantology (ITI), a professional association based in Basel, Switzerland.[8][9]
Patient complaints and criminal cases

[edit]In March 2018, Chandigarh Police registered a first information report (FIR) against Dhawan at the Sector 19 police station on the complaint of a US-based patient who had bought a dental tourism package from his clinic for US$10,500 in 2017.[10][7] She alleged that the implants were of poor quality, that her upper crowns and abutments fell off shortly after she returned to the United States, and that the promised hotel stay and sightseeing were not provided. She said she had been cheated of about ₹7.13 lakh.[10][6] Dhawan was booked under sections 420 (cheating) and 467, 468 and 471 (forgery) of the Indian Penal Code.[6][7] He denied the allegations, saying that he had already gone to court against the patient to recover unpaid fees after her cheques were dishonoured.[10][6] The Punjab and Haryana High Court granted him interim anticipatory bail in 2018.[6]
In May 2023, a Chandigarh civil court hearing a defamation suit filed by Dhawan granted an ad-interim injunction restraining the patient from publishing defamatory material about him on electronic media.[11]
In April 2025, the Chandigarh Police Complaints Authority (PCA), ruling on a complaint Dhawan had filed in 2018, held that there had been "gross misconduct" by the inspector and the investigating officer in the case and recommended a departmental inquiry against them. The PCA found that the patient's grievance concerned alleged deficiency in services, better suited to a consumer commission than to a criminal case, and called the FIR "motivated and without basis".[12][7] In February 2026, a Chandigarh court dismissed Dhawan's application seeking registration of an FIR against the police officials. The court held that the PCA's recommendation could not by itself establish that the officers had committed an offence, and said that his allegations of extortion and intimidation, first raised in 2019, appeared to be an "afterthought". According to the prosecution, the 2018 case was then under trial.[13]
2020 and 2021 cases
[edit]In September 2020, a second cheating case was registered against Dhawan at the same police station on the complaint of a patient from Kenya.[14][15] In October 2020, while hearing Dhawan's petition to move the investigation of his cases out of Chandigarh Police's jurisdiction, the High Court asked the Chandigarh director general of police to file an affidavit "in view of the serious allegations against the very high ranking police officials/officers", and directed that no coercive steps be taken against him in the new case.[14] On 26 November 2020, the High Court dismissed the transfer petition. It held that the alleged proximity of police officials to the 2018 complainant had not been substantiated, and that sending complaints to officials or being their friends on social media did "not give rise to any presumption of mala fide".[16][17]
In October 2021, a third FIR was registered against him at the Sector 19 police station. His application for anticipatory bail in that case was rejected in November 2021, and arrest warrants were issued against him in December 2021.[1]
Allegations against Rakesh Asthana and Tajinder Singh Luthra
[edit]In his 2018 anticipatory bail application, Dhawan alleged that the 2018 complainant was known to Rakesh Asthana, then special director of the CBI, and that Asthana had influenced Chandigarh Police to register a "false" case against him. Asthana told The Indian Express that he was not aware of the case and would not comment on a matter that was sub judice.[6] In 2019, Dhawan complained to the CBI director against Asthana, former Chandigarh director general of police Tajinder Singh Luthra and other police officers, alleging extortion, harassment and fabrication of documents. The CBI forwarded the complaint to the Chandigarh vigilance department, which was reported in January 2020 to be investigating it.[18][19]
Dhawan petitioned the Supreme Court seeking the prosecution of Asthana under the Prevention of Corruption Act, but withdrew the plea on 8 February 2021.[20][21] On 15 February 2021, the Delhi High Court dismissed his petition seeking directions to the CBI and the Central Vigilance Commission to act on his complaints. The court said there was no evidence that Asthana had ever influenced police officers in Chandigarh, noted that he had not been posted in Chandigarh at the relevant time, and imposed costs of ₹20,000, observing that the petition seemed to be "motivated due to some vindictive purpose".[2][21] On 20 February 2024, the Supreme Court dismissed his appeal against that order, saying that "no interference is called for under Article 136 of the Constitution".[20][22]
Alleged abduction (7 January 2022)
[edit]On 5 January 2022, the High Court directed Dhawan to appear before a magistrate at the district court complex in Sector 43, Chandigarh, on 7 January in connection with his anticipatory bail application in the 2020 case.[1] Dhawan alleged that on 7 January, as he went to appear, plain-clothes Crime Branch personnel forced him into a car near the court complex gate to prevent him from appearing. Police recorded that he had been arrested that evening near the bus terminal in Sector 43 in connection with another case.[1][3] He was remanded to seven days of police custody, then held in judicial custody, and released on 5 February 2022.[1]
In March 2023, the High Court directed the Punjab Police to set up a special investigation team and register an FIR against the police officials. The Chandigarh administration appealed, and the Supreme Court stayed that order. On 6 August 2024, the Supreme Court said the matter "may have taken a course in utter violation of the Constitution and laws" and directed the CBI to conduct a preliminary enquiry, including into whether Dhawan had been produced before a magistrate within 24 hours and whether his detention amounted to abduction.[3][15]
Following the enquiry, the CBI registered a case in early 2025 against seven Chandigarh Police Crime Branch personnel, including an inspector, under sections 365 (abduction with intent to confine) and 34 (common intention) of the Indian Penal Code.[1][23][24][25] According to the CBI's findings as reported, CCTV footage and call detail records placed Dhawan and the accused near the court complex at the relevant time, and he had been taken away in a private car registered to a relative of one of the accused.[1][23]
In early 2026, the CBI filed a charge sheet in a Chandigarh court naming nine police personnel as accused.[17][4][25] The charge sheet alleges that a WhatsApp group named "Dhawan" was created on the morning of 7 January 2022 to track him, that he was driven along internal roads for about three hours to avoid CCTV coverage before being handed over to a second team, and that a false daily diary report was prepared to account for his arrest. It also alleges that several of the accused discarded or destroyed their mobile phones.[4][26][25] The CBI asked the court to summon the accused and try them in accordance with law.[4]
