Regulatory dispute

[edit]

In 2014, the New Zealand Ministry for Primary Industries (MPI) disputed the use of the names "Manuka Doctor" and "Manuka Pharm" on honey products, arguing that the names constituted implied health claims under the Australia New Zealand Food Standards Code. The dispute concerned the use of the names in connection with food products and their export from New Zealand."NZ Honey fights MPI over alleged health claims on Manuka Doctor, Manuka Pharm branding". The New Zealand Herald. Retrieved 1 October 2026.

The High Court of New Zealand initially ruled against Honey New Zealand (International) Limited, finding that the names constituted implied health claims. Honey New Zealand appealed in relation to the "Manuka Doctor" mark. In 2016, the Court of Appeal overturned the High Court decision concerning that mark and declared that the words "Manuka Doctor" did not constitute a health or therapeutic claim."Judgments under the Food Act 1981". The dispute concerning "Manuka Pharm" was not pursued on appeal."Honey New Zealand (International) Limited v Director General of the Ministry for Primary Industries [2016] NZCA 141". Andrew Brown. Retrieved 1 October 2026.

Trademark dispute

[edit]

Manuka Doctor Limited was involved in a separate trademark dispute concerning the proposed registration of "MANUKA MEDIC", a mark used for mānuka-based skincare and related products. The company opposed the application on the basis that the mark was similar to its "MANUKA DOCTOR" trademark. The Assistant Commissioner of Trade Marks and the High Court both rejected the opposition."Manuka Doctor Ltd v Hill [2025] NZCA 516" (PDF). New Zealand Law Society. 2 October 2025. Retrieved 1 October 2026.

In October 2025, the Court of Appeal of New Zealand dismissed Manuka Doctor's appeal. The court held that the proposed "MANUKA MEDIC" mark could proceed to registration, finding that the marks were not sufficiently similar to create the relevant likelihood of confusion."Manuka Doctor Ltd v Hill [2025] NZCA 516" (PDF).
