The Labour Court of Nepal (Nepali: श्रम अदालत) is a specialized judicial body in Nepal that adjudicates disputes and legel matters related to employment and labours. It was established under section 151 of the Labour Act, 2017 (2074 BS)[1] The court was established to provide remedies in cases concerning workers, employers, employment conditions and other labour-related issues. It functions as part of Nepal’s judicial system with the mandate to resolve conflicts arising from labour laws and regulations. The Labour Court of Nepal established on 15 October 2020. [2].

Introduction and Formation

In Nepal, the formal judicial mechanism for resolving labour-related disputes began to develop with the enactment of the Labour Act, 2048 BS and the Labour Court Work Procedure Regulations, 2052 BS. Following a decision of the then His Majesty's Government (Council of Ministers) on 27 July 1992, the Labour Court was established with its headquarters in Kathmandu as a specialized institution for adjudicating labour disputes. With the enactment of the Labour Court (Procedure) Regulations, 2052 BS, labour-related legal disputes were initially heard and settled by a single-member authority under the applicable legal provisions. The development of Nepal's constitutional and legal framework subsequently led to changes in the structure of labour adjudication. In accordance with Article 152 of the Constitution of Nepal, 2015 (2072 BS), and Section 151 of the Labour Act, 2017 (2074 BS), the Government of Nepal reorganized the Labour Court as a three-member bench by a decision dated 19 Ashwin 2077 BS (5 October 2020).[3].

Establishment: This is a specialized court designed to resolve labor-related disputes swiftly and effectively. Structure: The court comprises a Chairperson and other members appointed by the Government of Nepal. Jurisdiction: The jurisdiction of this Labor Court extends across the whole of Nepal.[4].

The Labour Court was established as part of Nepal's legal framework for resolving labour-related disputes through a specialized judicial machanism. it's establishment was intended to provide an effective and accessible means of resolving disputes between emplyee and employers.

Jurisdiction

The Labour Court deals with matters assigned to it under the prevailing labour legislation of Nepal. These may include disputes concerning employment, termination of employment, labour rights and decisions made by labour authorities. The Labour Court adjudicates cases initiated under the Labour Act, 2017 (2074 BS) and hears appeals against orders and decisions of the Department of Labour and Occupational Safety, Labour and Employment Offices, establishments, and employers, as provided by law. It also has jurisdiction over disputes arising under the Trade Union Act, 2049 BS, and the Bonus Act, 2030 BS. The court hears appeals concerning decisions by employers to terminate employment or impose disciplinary action for misconduct, subject to the applicable legal provisions. Its jurisdiction and appellate powers are determined by the relevant labour laws and regulations. Decisions and final orders of the Labour Court are subject to appeal to the Supreme Court in cases where such an appeal is provided by law. In other matters, the decision or final order of the Labour Court is treated as final in accordance with the applicable legislationz. The Labour Court exercises its jurisdiction under the Constitution of Nepal and relevant legislation, including the Justice Administration Act, 2073 BS; Labour Act, 2074 BS; Bonus Act, 2030 BS; Trade Union Act, 2049 BS; Working Journalists Act, 2051 BS; Labour Court Work Procedure Regulations, 2052 BS; and Labour Regulations, 2075 BS.[5]

Matters that may come before the Labour Court of Nepal include disputes concerning:

  • employment and labour relations;
  • employment-related rights and obligations;
  • disciplinary actions and termination of employment, where provided by law; and
  • appeals against decisions of labour authorities or other bodies, where legislation grants a right of appeal to the Labour Court.

The court’s jurisdiction and procedures are defined by applicable laws, including the Labour Act of Nepal and related regulations.[6]
